General Terms & Conditions
- GENERAL TERMS
General terms and conditions for travel form an integral part of the contract or application form / voucher concluded by Atlas Express d.o.o., Portorož or authorized agency and traveler who is applying for a particular travel arrangement.
In the case that the Special Terms and Conditions or the specific program differs from any of the items covered by these General Terms and Conditions, the specifications or provisions stated in the program shall apply.
In the case of telephone or online bookings, it is understood that the Client has accepted the provisions of these General Terms and Conditions at the very moment of making the telephone or online booking. The Client may acquire the required information concerning the provisions of these General Terms and Conditions at www.kopertours.eu and www.atlasexpress.eu or on any website where Atlas Express d.o.o., Portorož as the provider of its own or foreign travel arrangements disseminates its services on the internet, where the General Terms and Conditions are clearly marked and widely accessible.
The General Terms and Conditions refer to the ordering party or the Client. The ordering party or the Client is any person or entity who has made a valid booking or a purchase of a travel arrangement or another service provided by Atlas Express d.o.o., Portorož.
- RATES
The prices of travel arrangements are determined within the travel arrangement program and they are valid from the date of the publication of the program.
The tour operator shall reserve the right to raise the price at least 20 days prior to the beginning of the travel arrangement in the case of the changes in currency exchange rates of the contracted (agreed upon) currency, or the raise of transportation costs, including the fuel prices, or the raise of fees for certain services (at airports, in ports, etc.) which affect the prices of travel arrangements.
The price increase is calculated with the percentage that equals the raise of the before mentioned elements of calculation. The travel arrangement contractor or the Client has the right to rescind the agreement on the organization of travel arrangement if the raise exceeds 10% of the basic arrangement price. In this case he has the right of reimbursement of the amount paid, however, with no right to the compensation for damages and possible visa, insurance, vaccination and similar costs.
The tour operator shall notify the Client of any changes of the travel arrangement price.
Atlas Express d.o.o., Portorož may recommend in the program that the Client pays the services (optional excursions, sports equipment rental and similar) which will be provided on the spot. In this case, Atlas Express d.o.o., Portorož is neither the operator nor the agent, but merely supplies the information. In this case, all Client claims are to be addressed solely to the local service provider on the spot.
Atlas Express d.o.o., Portorož may determine the arrangement price in the program, but at the same time states expressly that the price may be reduced should a certain number of applicants be reached or should other precisely determined conditions be met. Such a provision does not guarantee in any case that the conditions for the decrease in price will be met; the Client may therefore not rescind the agreement should the conditions for the decrease in price not be met.
Eventual discounts and benefits always exclude each other and are not accumulable. In the case several discounts and/or benefits are possible, the Client chooses the discount or benefit that suits him most and for which he fulfils the conditions.
III. SERVICES INCLUDED IN THE ARRANGMENT PRICE
Unless otherwise stated in the program, the arrangement prices include transport (land transport, maritime transport), accommodation and restaurant services stated in the travel arrangement and the costs of the travel arrangement organization, basic accident insurance, tour guide services (if not specified otherwise) as also booking fee.
Unless otherwise specified in the program, the prices of individual travel arrangements are per person for accommodation in double rooms.
In the case of a one-day tour, the price is per person for the travel arrangement as per predetermined program in the appropriate means of transport depending on the number of participants.
Prices for transfers are quoted in one direction only. If a traveler books the return transfer, the rate is double of one way transfer rate.
- SPECIAL SERVICES
Special services are the services which are normally not included in basic arrangement prices (a single room, a special diet, optional extra excursions, etc.).
In the case where special or additional services are offered in a specific arrangement, the Client may express the intention of purchasing those services upon booking, and pays them in addition to the basic arrangement price. The published prices for additional or special services are only valid in the case of ordering and paying them at the time of ordering and paying the basic arrangement at the office where it has been booked.
In the course of voyage itself, the Client may pay in addition, depending on the availability, the special services to the tour leader or Atlas Express d.o.o., Portorož representative or to the representative of the tour operator who organizes the Client’s travel arrangement at the location where they will be provided, at the price valid on the spot.
- BOOKING
Clients may book travel arrangements, provided by Atlas Express d.o.o., Portorož in its offer at any of the Atlas Express d.o.o., Portorož branch offices or at the authorized travel agencies. Upon booking, an agreement on travel arrangement is concluded between Atlas Express d.o.o., Portorož and the Client, which also acts as a proof of booking and may either include the details about the Client’s travel arrangement, or may refer to the travel arrangement, which contains the mentioned information. Upon booking, the Client is obliged to provide all the details and documents, as requested by the program of the travel arrangement, and to make the down payment and pay the booking and the reservation fee.
Atlas Express d.o.o., Portorož shall charge its Clients for its services standard reservation fees and fees for the drawing up of travel arrangement sale offers in the amount of 10,00 € per application for one day arrangements – excursions, and other travel arrangements or 20% of final arrangement price for services on order (incentives programs, m.i.c.e., …), which is published in a prominent place in the offices of Atlas Express d.o.o., Portorož.
In the case where the Client does not provide accurate information upon booking, the Client shall be liable for all costs or consequences, arising from inaccurate information. The booking is binding for the Client, who may not rescind the contract, except in accordance with the provisions regarding the cancellation of booking (Article IX of these General Terms and Conditions).
A booking shall be considered binding when the Client will have submitted an express written application or a signed agreement, but also upon the Client’s placing of an order in a written or oral form, containing the name and surname of the Client and other participants, the credit card number or the identification of another payment instrument; the making of the entire or partial down payment; the payment of the booking/reservation fee or any other conclusive act by the Client, indicating that the Client has submitted a binding booking, or an application, including any of the above mentioned information.
In the case the Client decides for an optional reservation (a request or an offer) of the tour operator, the terms and conditions for the conclusion of the agreement, marked on the optional document are valid.
A passenger at the moment of booking signs, that he is familiar with the General Terms and fully accepts them, thus making references to General Terms and Conditional legal obligation to the traveler as also Atlas Express d.o.o., Portorož.
Atlas Express d.o.o., Portorož must to at the latest when concluding the agreement on organizing a travel arrangement issue a confirmation voucher for the travel or conclude a written contract that contains all the mandatory components of the confirmation voucher, stipulated by the Slovenian Consumer Protection Act.
- PAYMENT
The date of payment shall be the day when the Client has made the payment at Atlas Express d.o.o., Portorož office or at an authorized travel agency, or once the payment has been registered on the Atlas Express d.o.o., Portorož transaction account.
Upon booking the Client makes the down payment in the amount of 30% of the arrangement price or otherwise, as specified in the arrangement program, and the reservation fee. The balance is to be paid at least 20 (twenty) days before the travel date, or else, as specified in the program.
In the case the balance of the agreed arrangement obligations is not settled by the Client or the office where he had booked the arrangement, it shall be considered that the agreement on travel arrangement has been cancelled, whereby the provisions regarding the Client’s cancellation of the agreement on travel arrangement according to these general Terms and Conditions shall apply accordingly.
Provided that the down payment and the booking fees have been paid in due time and correctly, they vouch, under the present General Terms and Conditions or according to the conditions, defined by specific terms and conditions or a specific program, for the Client to take part or, in other words, to have a reserved place in the specific travel arrangement or travel package.
Upon departure, the Client is obliged to present to the tour leader the document proving the payment of the travel arrangement (referral/voucher or/and the payment receipt); should the Client fail to do so, the tour leader shall deny the Client’s participation in the travel or travel arrangement.
Payments can be made in cash or by other stipulated means of payment. Should the payment for a travel arrangement or other Atlas Express d.o.o., Portorož services be made using non-cash means (credit cards, Maestro and other debit or ‘BA’ cards…), Atlas Express d.o.o., Portorož cannot, under any circumstances and in accordance with the conditions regarding non-cash business activities of financial institutions, reimburse the amount paid in cash. The Client may, however, demand a credit note, should he/she be entitled to one.
Special payment conditions are stated in the offer and/or in the services tariff price list.
VII. CANCELATION FEE
If the Client presumes, upon the booking of travel arrangement, that certain circumstances (likely to affect the Client or his/her immediate family) might prevent him/her from taking part in the travel arrangement; he/she may opt to deposit a cancelation fee.
The agreement on cancelation fee may be concluded at the latest on the day of the confirmation of the reservation and is applicable only in the event of official calls, unexpected aggravation of health condition or death in the immediate family (spouse, parents or children) and can only be enforced upon submitting an appropriate written document. The earnest deposit amounts up to 30% of the arrangement price.
A specific program may set a different amount for the cancelation fee, or may state that the cancelation fee is not possible or applicable.
In the event that the passenger submits an appropriate document that he/she cannot travel, but has not paid the cancellation fee, Atlas Express d.o.o., Portorož is entitled to retain the handling costs, as set out in the provisions of the General Conditions: passenger cancelation and change of the program.
VIII. TOUR OPERATOR’S RIGHT TO CANCELLATION OF TRAVEL ARRANGMENTS
Atlas Express d.o.o., Portorož shall reserve the right in accordance with Slovenian regulations to cancel the travel arrangement or to change the program of the travel arrangement. Atlas Express d.o.o., Portorož shall reserve the right to cancel the travel arrangement the latest 3 (three) days before departure, if the minimum of participants is not reached, as stated in the program, referring to the type of transportation:
– For bus transport, min 30 participants,
– For regular airlines in Europe, min 20 participants,
– For intercontinental air travel, at least 15 participants,
– For special arrangements for airplanes, trains, and maritime transport, at least 80% of occupancy of same
In cases where Atlas Express d.o.o., Portorož expresses a written guarantee of departure or ‘guaranteed departure’ cannot be cancelled due to insufficient number of participants.
Atlas Express d.o.o., Portorož reserves the right to completely or partially withdraw from the contract if, before or during the program of exceptional circumstances which could not have been expected to be removed or avoided, Atlas Express d.o.o., Portorož would constitute a valid reason for not entering into the contract if it had been known at the time of conclusion of the contract.
Atlas Express d.o.o., Portorož reserves the right to change the date and time of departure due to exceptional circumstances (eg. new timetable, the precarious situation in the country where the trip is organized, natural disasters …), which could not be expected, avoided or prevented. About the program changes, Atlas Express d.o.o., Portorož will inform passengers as soon as extraordinary circumstances arise, stating the reasons for the change. Costs incurred for changing the program will be on account of the Client.
Atlas Express d.o.o., Portorož cannot take responsibility for any changes to the program due to force majeure during the program. In this case, passengers will be provided services in a modified form, depending on the existing options.
In the event that Atlas Express d.o.o., Portorož will terminate a program, the passenger has the right to a refund of the price paid, but not the right to reimbursement of the cost of visas required for entry into the country where to travel, or the cost of vaccinations that were required to program.
About any subsequent modification in the program Atlas Express d.o.o., Portorož will notify the passengers immediately.
In case of exceptional circumstances which Atlas Express d.o.o., Portorož could not expect, avoid or deter from the accommodation stated in the program, Atlas Express d.o.o., Portorož is entitled to accommodate the passengers in another accommodation of same or higher category.
Atlas Express d.o.o., Portorož assumes no liability for any damage caused by the guest in the hotel or means of transport. Atlas Express d.o.o., Portorož does not assume liability for lost luggage during the execution of the trip and at the end of the arrangement.
- IX. PASSENGER CANCELLATION OR CHANGE PROGRAM
The Client is entitled to cancel the travel arrangement at the office where it has been booked. In the case when the travel arrangement is cancelled by the Client, Atlas Express d.o.o., Portorož shall have the right to the reimbursement of the costs arising from the cancellation of the travel arrangement. The amount to be reimbursed depends on the time in which the Client has delivered the cancellation. If the Client cancels the agreement on travel arrangement, he/she is obliged to reimburse Atlas Express d.o.o., Portorož the handling costs in the amount of 30% of the arrangement cost per referral or voucher.
– Up to 30 days before departure 20% of the price
– 29-15 days before departure 30% of the price
– 14-8 days before departure 50% of the price
– 7-1 days before departure 90% of the price
– On the day of departure and after departure 100% of the price.
The amount of cancelation of the trip, when Atlas Express d.o.o., Portorož is not a tour operator is determined by the general terms and conditions or other act of the organizer.
Notwithstanding the above, certain costs of cancelation, can also be higher when the conditional terms of organizing travel by Atlas Express d.o.o., Portorož are dictated by the current terms of sale and stipulated by business partners.
In the event that the terms for the reimbursement of expenses due to cancellation are specified differently in a specific program, there are to apply.
At the oral termination of the program, the passenger must sign a written declaration of termination of the program. In case this is not done, it shall be deemed that the program has not been terminated.
During the course of the program, the passenger may only terminate the program at their own request and with a written statement of termination.
In the event that a passenger terminates in writing at her/his own request during a program, he/she is not entitled to reimbursement, unless he terminated the program due to circumstances that could not be avoided or prevented.
If the passenger during the trip of his choice, modifies the program or does not travel under the program, which is an integral part of the contract with Atlas Express d.o.o., Portorož, it is considered that the passenger has withdrawn from the contract during the travel. In this case, the passenger is responsible for the eventually costs/damages caused by this.
X. SALE AND INTERMEDIARY ARRANGEMENTS
Atlas Express d.o.o., Portorož is not responsible for services in the programs, where it does not act as an organizer, but only as an intermediary in the conclusion of the agreement on the organization of the trip. In such cases, it is only responsible for informing or as intermediary; information received from the organizer is passed on to the traveler.
All programs where Atlas Express d.o.o., Portorož is an intermediary are separately marked on the form / voucher. Conditions of registration, payment and possible cancellation of travel are in accordance with the terms of the other organizer. It is considered that Atlas Express d.o.o., Portorož is selling such programs on behalf and for the account of third parties.
Any complaint shall be resolved by the traveler with the organizers of the program.
- TELEPHONE SALES PROGRAMS
In the case of telephone selling, the contract shall be deemed to have been concluded on the date of written confirmation of Atlas Express d.o.o., Portorož. In the case of an agreement on payment by money order the passenger is obliged to pay the ordered services within the stipulated time. In the event that a passenger has not paid within this period it shall be deemed that the contract has not been concluded.
In the case of telephone orders or sales program, where each program permits, it is considered that the passenger has adopted the provisions of these General Terms and Conditions at the moment when he booked the program.
XII. SALES PROGRAMS VIA THE INTERNET
In the case of booking or sale of programs over the internet the General Terms and Conditions and instructions for tour programs and special conditions to apply or offers posted on the Atlas Express d.o.o., Portorož web page – www.kopertours.eu
In the event that the provisions of these General Terms and Conditions and specific conditions of the offer posted on the Internet site of the Atlas Express d.o.o., Portorož differ, special conditions and offers to apply.
It is considered that the passenger has adopted the provisions of these Terms and Conditions at that moment, when he orders the program of Atlas Express d.o.o., Portorož via the Internet.
An essential condition for the validity of the application is the confirmation of payment within the agreed time. In the event that within that period, the service is not paid, it shall be deemed that the service was never ordered.
For selling of the products, the agency uses the website www.kopertours.eu and applies the following discounts:
- 5% discount if payment is made via bank account
- 20% discount for early bookings for more than 90 days before the departure in case immediate payment arrangement
- 10% discount in the event that a trip is organized for a group of 8 people as a closed party
- 15% discount in the event that a trip is organized for a group of more than 65 persons
- 10% discount in the event that a customer books two or more trips, one of which must take place in Slovenia
XIII. INFORMATION
The information provided to the Client at an office where the Client has booked the travel arrangement shall not be binding for Atlas Express d.o.o., Portorož more than the information stated in the travel arrangement program or offer. When in doubt, the following shall apply without exception: written offer, written information or written explanation.
Prices, photos and advertising material on the Internet are for information purposes only, and Atlas Express d.o.o., Portorož does not guarantee the completeness and accuracy of the data and their appearance.
Published web pages of hotels serve for additional information. On the published hotel sites Atlas Express d.o.o., Portorož has no influence and shall not be liable.
XIV. NOTICE PRIOR TO DEPARTURE
For all programs, including air transport, passenger will receive, no later than 7 (seven) days prior to departure, the notice which contains additional information and details related to the program.
If the notice is not received in this period, the Client is obliged to contact the point of sale where he/she applied, either in person or by phone, otherwise Atlas Express d.o.o., Portorož will assume that the notice was received.
Expenses incurred due to incomplete or incorrect addresses on the registration form / voucher, and therefore shall not come in time; such expenses are carried by travelers.
- CLAIMS or COMPLAINTS
Each passenger is entitled to claim or complaint about inadequate services.
The passenger must as soon as possible report a complaint to the service provider, the organizer or retailer or the local representative of the organizer or seller, in writing or in another appropriate form, any error in the implementation of the program.
In the case where, judging from the nature of the complaint (e.g. poor cleanliness of the room, room equipment or location, etc.), the problem could have been resolved on the spot, but the Client has failed to report the shortcomings and inform the above persons about the irregularities, it shall be considered that the Client has agreed to such a service, thereby losing ground for any subsequent claims, demanding a reduction of the arrangement price or a refund of damages. Atlas Express d.o.o., Portorož shall not process the complaint to which the Client has not enclosed a written record of the tour operator’s representative or the provider of the services about the complaint, from which it should be evident that it was not possible to resolve the shortcomings on the spot.
The Client’s complaint is to be made about the inappropriate services immediately on the spot to the tour operator’s representative or, in his absence, to the provider of services. The Client must co-operate with the representative in good faith for the elimination of reasons for the complaint. Should the client refuse to accept the offered solution of the complaint which corresponds to the services paid according to the program, Atlas Express d.o.o., Portorož shall not take into account subsequent damage claims or reductions of the travel arrangement price. In the case the reasons for the complaint cannot be rectified, the Client together with the representative composes a written record. After the return from the voyage the Client must file a written complaint within the deadline determined by the law, i.e. in two months after the conclusion of the travel arrangement, by registered mail to the address: Atlas Express d.o.o., Portorož, Obala 55, 6320 Portorož, and enclose the evidence that will prove the substantiation of the complaint (obligatory written confirmation, signed by the representative or the provider of the services, eventual bills for additional costs, etc.).
The tour operator is obliged to send a written reply for the first time in 8 days after the reception of the complaint and finally in appropriate delay, necessary for the acquisition of the information about the reasons for the complaint from the provider of the services;
XVI. USE OF INFORMATION
Atlas Express d.o.o., Portorož will use all data on passengers in accordance with the Law on the protection of personal data.
It is considered that the passenger with the signing of the contract agrees to the use of this information for direct marketing purposes, market research, customer segmentation, statistics and information about the offer Atlas Express d.o.o., Portorož.
If the passenger does not want to provide his information for above uses, he/she must notify upon booking the program.
XVII. TRAVEL DOCUMENTS
The client is obliged to get acquainted with the regulations concerning passports, visas, foreign exchange, customs and health regulations. The Client is obliged to take care that he/she, their documents and luggage satisfy the conditions, stipulated in border, customs, health and other regulations of his/her country, as well as of the country of destination or the country he/she travels through.
The Client booking a travel arrangement abroad must be in the possession of a valid passport or other adequate document permitting entry in a specific country.
In the case where specific countries condition the entry into their territories with the duration of validity of the travel document starting from the day of entry, it is the Client’s exclusive responsibility to check these requirements and Atlas Express d.o.o., Portorož shall not be liable for any inconvenience or a forced termination of the travel arrangement arising from the above conditions.
The Client is bound to procure the visas for the countries to which he/she travels and to undergo the vaccinations required for these countries before the departure date or until the deadline set in the program. Should the Client refuse to do so, Atlas Express d.o.o., Portorož shall act in accordance with the provisions for Client cancellations of travel arrangements. In the cases where Atlas Express d.o.o., Portorož is in charge of providing the visa for the Client, Atlas Express d.o.o., Portorož cannot vouch that the Client will be issued the visa. Atlas Express d.o.o., Portorož shall not refund the Client the costs of visa issuing. Atlas Express d.o.o., Portorož cannot guarantee the accuracy of the information provided by the competent embassies. In the event of a refused entry into a country or other such obstacles, the Client shall bear the entire costs. The mediation of Atlas Express d.o.o., Portorož with visa issuing is not included in the price of the arrangement; it is charged separately. It shall be considered that the Client has opted to arrange the visa on his/her own should he/she not provide Atlas Express d.o.o., Portorož with the required documents for issuing a visa within the deadline set in the program or the offer.
Due to the requirements in international passenger traffic (air, boat, coach…), the Client is bound to communicate upon booking all of the required details about all the participants of the travel arrangement or holiday for whom the Client has made the booking. The details must match entirely the details in the travel documents, which the participants of a travel arrangement are required to carry with them, according to the regulations regarding the crossing of the state border and equivalent foreign acts. In the case where wrong information causes delays, extra costs or the termination of the travel arrangement, all of the resulting costs for all the participants of the travel arrangement shall be the sole responsibility of the Client.
The Clients is obliged to respect the house rules in restaurant and accommodation facilities and to co-operate in good faith with the tour operator’s representative and the service provider. Should the Client fail to respect his/her obligations, he/she shall be responsible for all the damages, caused to the tour operator and the tour operator declines any responsibility for the damages the Client could have incurred in such a case. During the travel arrangement the Client is obliged to behave in such a way that he/she does not endanger the lives or health of his fellow passengers and does not put at risk the course of the travel arrangement. Should the Client behave contrary to this provision the tour operator’s representative has the right to exclude him/her from further travel without the refund of any costs, except the amounts, payable on the spot.
XVIII. LOSS OF DOCUMENTS
Should the Client’s documents get lost or stolen, but are indispensable for the continuation of the travel arrangement or for the return home; the Client must procure replacement documents at his/her own costs.
The Client may turn to the Atlas Express d.o.o., Portorož tour leader or representative or to a representative of a tour operator that organizes the Client’s travel arrangement for advice and help with the ensuing formalities.
In the case when the Client must terminate the travel arrangement underway due to lost or stolen documents, he/she will not be eligible for any reimbursement of the paid travel arrangement, or for a refund of any other ensuing costs.
XIX. HEALTH REGULATIONS
According to the requirements of the World Health Organization the Clients travelling into certain countries are required to get vaccinated and to procure an appropriate document. Vaccination is also obligatory in the case such requirements are adopted after the conclusion of the agreement on travel arrangement; this is not a justified reason for the rescission of the agreement unless some contraindications exist for the Client’s health. In this case the Client is obliged to present a medical certificate.
In the case where a travel arrangement requires certain vaccinations, the Client is obliged to procure the international certificate of administered vaccinations (yellow booklet) with the reacquired vaccinations.
Atlas Express d.o.o., Portorož shall not be held responsible for any complications or the Client’s termination of the travel arrangement underway due to the Client’s non-compliance to the health regulations of the destination country, or the non-compliance to the requirements of the selected travel arrangement, nor will Atlas Express d.o.o., Portorož be liable for any ensuing costs.
- BAGGAGE
The transportation of luggage is not the responsibility of the organizing party, the agent or the mediator; they shall not be liable for any lost or damaged luggage nor for any theft of luggage or other valuables at the hotel. The claims for any lost or damaged luggage are to be made by the Client and addressed directly to the carrier or the hotel. For the transportation of special items, such as bicycles, surfboards, golf equipment, etc., the Client shall pay a supplement directly to the carrier, usually upon departure at the airport. In any event, the intention of transporting such luggage must be notified already at the time of booking the travel arrangement. However, the airline reserves the right to refuse the transportation of such luggage due to certain limitations in load capacity. All of the ensuing costs or damages are the sole liability of the Client.
The transportation of luggage up to a certain weight, determined by the carrier, is free of charge. When travelling by air, the Client is entitled to a free transportation of luggage up to a certain weight (according to the provisions of the airline); each additional kilogram shall be charged directly to the Client by the airline, on the spot and in local currency or according to the provisions of the airline. Children of up to two years of age are not entitled to a free transportation of luggage.
When travelling by air, the responsibility for the lost luggage is in the exclusive domain of the airline, according to the regulations that apply in international airline passenger traffic.
Atlas Express d.o.o., Portorož shall not be liable for any theft or damage to the Client’s luggage or other personal items, valuables or documents, occurring at accommodation facilities (hotel rooms, holiday apartments, etc.) or means of transport (airplanes, coaches, boats, etc.).
XXI. TRAVELLING WITH CHILDREN
Every child, regardless of age and amount of any discounts that are marked in each program must be stated on the travel document or application form / voucher and must have valid travel documents required for entry into the country of destination.
In the event that the child is not stated on the travel document or application form / voucher is considered that this child has no right to travel under this program.
XXII. CATEGORIZATION OF ACCOMODATION FACILITIES
Accommodation facilities in the programs are marked according to the official national categorization in individual countries, applicable at the time of the publication of the program on which the operator has no impact.
Facilities in each category are classified according to the law (applicable at the time the program), which are therefore not categorized by Atlas Express d.o.o., Portorož, therefore Atlas Express d.o.o., Portorož is not liable, except in cases when it is particularly indicated that this is an estimate of Atlas Express d.o.o, Portorož.
Standards of tourist offers for selected destinations are different and not comparable.
XXIII. ACCOMODATION IN ROOMS / APARTMENTS
If a passenger by booking paid an extra fee for room / apartment with special features (view on the sea side with balcony, equipment, location-orientation specified floor, …) will be accommodated in one of the rooms / suites that are officially registered to accommodate guests in a particular facility.
Distribution of rooms is the responsibility of the service provider or hotelier; Atlas Express d.o.o., Portorož does not have any influence on this, your wishes may be communicated, but cannot guarantee that these will also be met.
In case of late arrival of the carrier at the hotel late at night or early in the morning guests are not entitled to a refund of one night, as the number does not change overnight. For the night time to count from is counted the time from about 12 hours to about 12 hours the next day. The same applies for early departures from the hotel.
The rooms are generally ready for use after 14:00h on the day of arrival; they must leave the rooms on the last day until 10:00 am. The hotel house rules must be respected regardless of the time of arrival or departure of an aircraft or ship.
Extra beds are in most hotels auxiliary beds with an iron frame or a pull-out couch in the apartments.
Due to specific climate conditions, insects cannot be completely avoided even in the hotel facilities. We recommend the use of insecticides and mosquito electrical plugs.
Beaches in most tourist places are public and are only managed by hoteliers (chairs, umbrellas, bars). Cleaning beaches is the task of the local government; although hoteliers usually provide for the cleanliness of the beaches.
In the event of a booking in an apartment building and individual apartments, it is possible to check-in the apartment after 16.00h on the day of commencement of the program, whereas on date of departure it is necessary to leave the apartment until 10:00h am, unless otherwise stated in the program.
XXIV. SINGLE ACCOMODATION IN DOUBLE ROOM
In the case of individual requests for accommodation in a double room, a passenger may leave to Atlas Express d.o.o., Portorož to endeavor to find a passenger on the same program, who is willing to share a room with him.
Notwithstanding the above an individual passenger upon registry must pay for a single supplement, for example, that Atlas Express d.o.o., Portorož does not find another single passenger who is ready to share the room.
In the event that an individual traveler finds a companion, such a traveler is entitled for a refund of the extra charge for accommodation in a single room or the fee charged for the final payment of the program.
XXV. WINTER PROGRAMS
The lack of snow will not to be considered a force majeure, and Atlas Express d.o.o., Portorož will consider a passenger trip cancellation due to lack of snow in accordance with the General Terms and Conditions.
XXVI. “LAST MINUTE” OFFERS
All offers for »last minute« programs are for information purposes only as regards name of hotel of accommodation.
The name of the hotel will be advised by the representative of Atlas Express d.o.o., Portorož at destination of accommodation, unless otherwise specified in the program.
XXVII. “ALL INCLUSIVE” OFFERS
Certain facilities offer a range of “all inclusive” services, where prices include virtually all offers such as: food, drinks majority, sports, entertainment, etc..
Offer “all inclusive” differs both from destination to destination, as well as from hotel to hotel. For most of the hotels of lower category (3 or 4 stars), which offer these kind of services, applies a more appropriate title “full board”, because they mostly include breakfast, lunch and dinner with drinks at meals, which in principle are draft. A hotel offer of “all inclusive” is linked to the hotel House Rules, arrival at the hotel and departure from the hotel, generally from 12 to 12 hours, regardless of the time of departure to the airport.
XXIX. FINAL TERMS
All prices listed in the offers of Atlas Express d.o.o., Portorož already include the value added tax (VAT).
In the event of a dispute between the parties, the dispute will be resolved by the competent court in Piran, Slovenia. The Slovenian wording of the General Terms and Conditions will apply in court. Both parties shall do the outmost to resolve any and all disputes in an amicably way failing which the dispute will be resolved by the competent court in Piran, Slovenia.
These General Terms and Conditions apply to all the agreements, concluded from the day of the publication.
